Terms for using this website, plus the standard terms that sit behind an engagement. Written to be read rather than to be survived.
01Who these terms are with
This website is operated by EASTWIND CLUSTER LIMITED, a company registered in England & Wales under company number 15485126, with its registered office at C/O External Accounts, Central House, 20 Central Avenue, St Andrews Business Park, Norwich, Norfolk, NR7 0HR, United Kingdom.
Using this site means accepting the terms on this page. If you engage us for work, a separate written proposal will set out the scope, fee and schedule, and that proposal takes precedence wherever it differs from this page.
02What this site is
The pages here, including everything in the library, are general information about how we work and how search tends to behave. They are not advice for your specific situation, and acting on them is your own commercial judgement.
We keep the content accurate and revise it when it stops being true, but we do not warrant that every statement applies to every business or platform.
03No guaranteed results
Search engines are third-party systems we do not control. Nobody can guarantee a ranking, a volume of traffic or a number of enquiries, and any supplier who does is either guessing or intending to use tactics that eventually cost you.
What we commit to is the work described in a proposal: the research, the pages, the fixes, the reporting, done properly and on the agreed schedule.
04Fees and payment
- Fees are fixed for a defined scope, or an agreed monthly amount for an ongoing programme, and are stated in the proposal before work starts.
- Invoices are payable within 14 days unless the proposal says otherwise.
- Ongoing programmes run for an initial three months, then continue monthly until either side gives 30 days' notice.
- Expenses over a nominal amount — paid tools, stock media, third-party specialists — are agreed with you in advance and passed on at cost.
05What we need from you
Engagements depend on reasonable access and reasonable responsiveness: access to the site, analytics and Search Console; a named person who can approve work; and factual review of anything we write about your business.
Where a delay on your side pushes a schedule, we will say so at the time rather than absorb it silently and rush the work later.
06Ownership of the work
Once an invoice is paid, the deliverables produced for you — copy, articles, designs, code, research documents — belong to you outright.
We keep ownership of our own pre-existing methods, templates and internal tooling, and of anything we developed before or outside your engagement. Nothing stops you taking the deliverables elsewhere.
We may describe the type of work done in general terms. We will not name you, publish figures or show your material as an example without written permission.
07Your content and third-party rights
You confirm that material you supply — text, images, data, trademarks — is yours to use, and that publishing it will not infringe anyone else's rights.
Where we source images or data on your behalf we use properly licensed material and tell you what the licence permits.
08Confidentiality
Anything you tell us about the business that is not public stays between us, and the same applies in reverse. This survives the end of an engagement.
09Liability
Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.
Subject to that, our total liability in connection with an engagement is limited to the fees paid for it, and we are not liable for indirect or consequential loss, including lost profits, lost revenue or loss of anticipated savings.
10Ending an engagement
Either side can end an ongoing programme with 30 days' written notice. Fixed-scope work can be stopped at any point; you pay for work completed and properly incurred costs up to that point, and we hand over everything produced so far.
On request we transfer accounts, files and documentation back to you promptly. Nothing is held hostage.
11Governing law
These terms and any engagement are governed by the laws of England and Wales, and the courts of England & Wales have exclusive jurisdiction.
A proposal always sets out the specifics for your project. If anything on this page conflicts with your proposal, the proposal wins. Questions to support@eastwindcluster.com.
